Señor Taco — Promotional Communications & Data Use Policy

1. Agreement to These Terms

By providing your phone number and/or email address to Señor Taco ("we," "us," or "our") through our website, online ordering platform, or in-store sign-up, you agree to these Terms & Conditions. If you do not agree, please do not submit your contact information.

These terms govern how Señor Taco collects, uses, and protects your personal information and how we may contact you for promotional purposes. By creating an account, you are opted in to promotional SMS and email communications by default — you may update these preferences at any time in your Account Settings.

2. Information We Collect

When you create an account or sign up for promotional communications, we may collect:

  • Phone number — used for account verification (OTP) and SMS communications
  • Name (first and last) — used to personalize your account and communications
  • Email address — used for promotional emails and order confirmations
  • Date of birth — used solely to deliver your birthday reward
  • Order history — used to power the loyalty punch card and reorder features

We do not collect payment card information directly. All payments are processed securely through Stripe.

3. How We Use Your Information

Your information is used exclusively by Señor Taco for the following purposes:

  • Sending promotional SMS text messages about deals, new menu items, and special offers
  • Sending promotional emails about catering, events, loyalty rewards, and new locations
  • Sending order confirmations and receipts via email
  • Administering the loyalty punch card and birthday reward programs
  • Improving our service and personalizing your experience
We do not sell, rent, or share your personal information with third parties for their marketing purposes. Your data is used only by Señor Taco to communicate with you directly.

4. SMS Text Message Communications

By providing your mobile phone number, you consent to receive recurring automated promotional and informational text messages from Señor Taco at the number provided. These may include:

  • Limited-time promotions and discounts
  • New menu item announcements
  • Loyalty reward notifications
  • Online ordering launch and feature updates

Message frequency varies. Standard message and data rates may apply depending on your mobile carrier plan.

Default opt-in: When you create a Señor Taco account, promotional text messages are enabled by default as part of your account setup. You can turn this off at any time — it takes just a few seconds in your account settings.
To opt out of SMS messages at any time: Reply STOP to any text message you receive from us, or turn off "Promotional Texts" in your account settings at My Account. You will receive one final confirmation message.

5. Email Communications

By providing your email address, you consent to receive promotional emails from Señor Taco, including special offers, catering announcements, and loyalty updates.

Default opt-in: When you create a Señor Taco account, promotional emails are enabled by default as part of your account setup. You can turn this off at any time in your account settings — your preference is always respected.
To opt out of promotional emails at any time: Click the "Unsubscribe" link at the bottom of any email, or turn off "Promotional Emails" in your account settings at My Account.

Note: Even if you opt out of promotional emails, you may still receive transactional emails such as order confirmations and receipts, as these are necessary for your use of our ordering platform.

6. Data Security

We take reasonable technical and organizational measures to protect your personal information against unauthorized access, loss, or misuse. Your account is protected by phone-based OTP (one-time password) verification.

While we strive to protect your data, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security.

7. Online Ordering Terms

By placing an order through our online ordering platform, you agree to the following:

  • Order accuracy — You are responsible for reviewing your order before submission. Once submitted and payment is confirmed, orders cannot be modified.
  • Pickup responsibility — For pickup orders, you are responsible for collecting your order within a reasonable time of the estimated pickup window. Señor Taco is not responsible for orders left uncollected.
  • Scheduled orders — Scheduled pickup orders are sent to the kitchen 15 minutes before the selected time. Arrival times may vary based on kitchen volume.
  • Order cancellations — Once payment is processed and the order is confirmed, cancellations are not guaranteed. Please call your location directly as soon as possible if you need to cancel.
  • Refunds — Refunds for online orders are handled at the discretion of the restaurant. If your order was incorrect or not fulfilled, please contact us within 24 hours using our contact form or by calling your location directly.
  • Alcohol items — Orders containing alcoholic beverages (including soft serve margaritas) require valid government-issued ID verifying you are 21 or older upon pickup. We reserve the right to refuse service if valid ID cannot be provided.
  • Pricing — Menu prices are subject to change. The price displayed at time of order placement is the price charged. Tax is calculated at 7%.
  • Payment processing — All payments are processed securely through Stripe. We do not store your payment card information. See our Privacy Policy for details on how payment data is handled.

8. Data Retention

We retain your personal information for as long as your account is active or as needed to provide services. If you request deletion of your account, we will remove your personal data within 30 days, except where retention is required by law or for legitimate business purposes (such as completed transaction records).

9. Children's Privacy

Our services are not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us immediately.

10. Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our platform or services after any changes constitutes your acceptance of the updated terms.
